These Terms and Conditions of Use and Privacy Policy (the "Terms and Conditions") were last updated on March 26, 2012.

College Prowler, Inc. ("College Prowler" or "we") welcomes you. We provide the College Prowler Services (as defined below) to you subject to the following Terms and Conditions. These Terms and Conditions may be modified at any time and from time to time; the date of the most recent changes or revisions will appear on this page. Continued access to the College Prowler Services by you will constitute your acceptance of any changes or revisions to the Terms and Conditions. If you do not agree with the Terms and Conditions, please do not use the College Prowler Services. College Prowler does not control, and is not responsible for, any third-party site to which the College Prowler Services link.

Description of College Prowler Services

College Prowler Services refers to the websites located at www.collegeprowler.com and ovrlap.com as well as online services that include, but are not limited to, email newsletters, premium online content, Facebook applications, scholarship listings, mobile applications and various medium or devices now known or hereafter developed (collectively, the "College Prowler Services").

The materials contained on the College Prowler Services are provided by College Prowler as a service to you for your noncommercial, personal use on an "as is, as available" basis and may be used by you for information purposes only. You acknowledge that you are using the College Prowler Services at your own risk. College Prowler assumes no responsibility for error or omissions in these materials. College Prowler makes no commitment to update the information contained herein. College Prowler makes no, and expressly disclaims any and all, representations or warranties, express or implied, regarding the College Prowler Services, including without limitation the accuracy, completeness, or reliability of text, graphics, links, products and services, and other items accessed from or via the College Prowler Services, or that the College Prowler Services will be uninterrupted, error-free, or free of viruses or other harmful components. No advice or information given by College Prowler or any other party via the College Prowler Services shall create any warranty or result in any liability.

College Prowler does not warrant or make any representations regarding the use or the results of the use of the materials at the College Prowler Services in terms of their correctness, accuracy, timeliness, reliability, or otherwise. Under no circumstances shall College Prowler or any of its parents, subsidiaries, affiliates, or their respective partners, officers, directors, employees, or agents be held liable for any damages, whether direct, incidental, indirect, special, or consequential, and including, without limitation, lost revenues or lost profits, arising from or in connection with your use, reliance on, or performance of the information on the College Prowler Services.

College Prowler periodically schedules system downtime for maintenance and other purposes. Unplanned outages also may occur. College Prowler shall have no liability for the resulting unavailability of the College Prowler Services or for any loss of data or transactions caused by planned or unplanned system outages, or any outages of web host providers or the Internet infrastructure and network external to the College Prowler Services.

Account Registration Information

You must be 13 years of age or older to create an account and use the College Prowler Services. The College Prowler accounts are for high school students and those seeking higher education as well as designated representatives of colleges, universities, high schools and for profit and not for profit post-secondary educational institutions ("Representative(s)"). By accepting these Terms of Use you warrant to College Prowler that you are 13 years of age or older and that you have the authority and capacity to agree and abide by these Terms of Use. If you are a Representative, you also warrant that you are employed by the institution you have designated and are authorized to act on its behalf in an official capacity on the College Prowler Services.

You may opt out of any future usage of your account in our database by cancelling your account. However, if you have chosen to share your account information with a Representative, the Representative may have saved a copy of your account information, and College Prowler is not responsible for the retention, use of, or privacy of accounts in this situation.

Your use of the College Prowler Services does not take the place of any entrance application. It does not guarantee the admittance into a school and College Prowler does not make any guarantees, representations, warranties or promises that such will assist you in getting admitted into a school. College Prowler Services users are the sole creators of their accounts and College Prowler does not independently verify the information provided.

You are responsible for maintaining the confidentiality of your College Prowler Services account and password. You shall be responsible for all uses of your registration and password, whether or not authorized by you. You agree to immediately notify College Prowler of any unauthorized use of your account or password.

Referral Rewards Rules

When you register or login to certain College Prowler Services accounts you may receive a unique referral link. This link can be shared publicly to encourage anyone to register for certain College Prowler Services accounts. When a new user registers using your specific referral link, you will earn referral credit for that person. Referral credit is not earned if the person referred already has an account or if they provide false information when registering. Referral credit is only earned when your specific referral link is used to register. It is not earned if a person you refer creates an account without using your specific referral link or if the person leaves the College Prowler Services and returns at a later time without using your referral link and registers. When a person who you have referral credit for wins a College Prowler funded scholarship, you win the dollar amount of that scholarship as well ("Referral Rewards").

Referral Rewards only apply to scholarships funded by College Prowler. They do not apply to other scholarships listed on the College Prowler Services that are not funded by College Prowler. You are only eligible to win Referral Rewards on users who you refer directly. If you refer a user and that user refers another user who wins a College Prowler funded scholarship, you do not win. A maximum of one referrer can win Referral Rewards for each College Prowler funded scholarship. In order to earn Referral Rewards, you must earn referral credit for a scholarship winner before they win the scholarship. Referral Rewards do not apply to registrations for College Prowler Facebook applications.

Expressing Interest in a School

Users of the College Prowler Services may be prompted to express their interest in a school by expressing "Yes", "Maybe", or "No" to the prompt, "Are You Interested?" Each time you select "Yes", "Maybe", or "No", we update your Recommended Schools list accordingly as we learn your school preferences. If you select "Yes" for a school, then we'll add it to your "My Schools" list and attempt to inform the school of your interest. If we can reach the school, we'll share your profile information with them so that they can contact you directly. If you select "Maybe", then we'll only add the school to your "My Schools" list and will not connect you with the school. And if you select "No", then we'll remove it from your list of possible recommended schools. Regardless of your level of interest in a school, College Prowler always recommends that you follow-up with schools directly as we cannot guarantee that we can connect you with every school. This feature is only available to those who have registered for a free account.

User Generated Content

College Prowler, through its forums, provides users an opportunity to post content to the College Prowler Services. College Prowler does not necessarily endorse, support, sanction, encourage, or agree with content posted by users. You shall not upload, post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law, or infringe upon another's copyright or trademark. You understand that all information, data, text, software, music, sound, photographs, video, messages, or other materials uploaded, posted or transmitted in a College Prowler Services forum, whether publicly uploaded or posted or privately transmitted, is the sole responsibility of the person from whom such content originated. This means that you, and not College Prowler, are entirely and solely responsible for all content that you upload, post, or otherwise transmit via the Web site. College Prowler does not and cannot review the content posted by users and is not responsible for such content. However, College Prowler shall have the right, but not the obligation, to delete, move, or edit any content that violates this agreement or is otherwise objectionable as determined by College Prowler in its sole discretion and without notice. You may report any violations of these posting guidelines by emailing support@collegeprowler.com.

If you upload, post, or otherwise transmit content to the College Prowler Services, you acknowledge that any such submissions may be edited, removed, modified, published, transmitted, and displayed by College Prowler or third parties in any medium now existing or hereinafter invented, and for any purpose, including commercial uses. You waive any moral rights you may have in having the material edited, removed, modified, published, transmitted, or displayed in a manner not agreeable to you.

You agree to indemnify College Prowler and its parents, subsidiaries, and affiliates, and each of their respective partners, officers, directors, employees, and agents, against, and to hold each of them harmless from, any and all claims and liabilities (including attorney's fees) that may arise from your submissions, from your unauthorized use of material obtained from the Web site, from your breach of these Terms and Conditions, and from any such acts arising through your use of the College Prowler Services.

Copyright

All materials published on the College Prowler Services are protected by copyright laws, and may not be reproduced, republished, distributed, transmitted, resold, displayed, broadcast, or otherwise exploited in any manner without the express written permission of either College Prowler or, in the case of content licensed by College Prowler from third parties, the entity that is credited as the copyright holder of such licensed content. You may download freely accessible material (one copy per page) from the College Prowler Services for your personal and noncommercial use only, without altering or removing any trademark, copyright, or other notice from such material.

In the event you believe that any content posted on the College Prowler Services infringes your copyright or other intellectual property rights, you may notify College Prowler by providing the information required by the Online Copyright Infringement Liability Limitation Action of the Digital Millennium Copyright Act, 17 U.S.C. 512, to College Prowler's Copyright Agent:

Featured Services

College Prowler is committed to providing users of its site with as many features as possible. The companies that College Prowler selects as featured services providers offer products and services that site visitors may find useful. College Prowler in certain cases may have a business relationship with certain third parties that it selects as featured service providers. College Prowler is not responsible for the accuracy or reliability of any advice or information given, or of any statement made, by the companies providing featured services, or for the content, services, products, or advertising on or available from their Web sites, or for the availability and operations of their Web sites.

Educational Institutions

We work with colleges, universities, high schools and for profit and not for profit post-secondary educational institutions to provide targeted recruiting and outreach. Only those school representatives who have registered and been authenticated by College Prowler in accordance with our policies are allowed to participate. Authorized personnel from the educational institutions may also provide information on the schools, update admissions data and provide calendars or other information. The accuracy of this information is not guaranteed.

Educational institutions use our student data in their recruitment efforts, but the College Prowler Services is not an application tool. All of our users must still perform the institution appropriate application process as the College Prowler Services does not replace the application process.

Jurisdiction

You agree that any claim, action, or proceeding arising out of these Terms and Conditions, or your use of the College Prowler Services, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania applicable to contracts to be wholly performed therein, and any action based on or alleging a breach of this Agreement must be brought in a state or federal court in Pennsylvania. In addition, you agree to submit to the personal jurisdiction of such courts.

Privacy Policy

This privacy policy applies to all of the College Prowler, Inc. ("College Prowler") websites, scholarship listings, mobile features and applications including (collegeprowler.com), (ovrlap.com) and the College Prowler applications and pages on Facebook (the "College Prowler Services"). This policy does not cover information collected on any third-party sites to which the College Prowler Services link. Your use of the College Prowler Services is subject to our Terms and Conditions which can be read here. If you access the College Prowler Services through Facebook, you may be required to read and accept the Facebook terms of service and privacy policy.

How does College Prowler use information supplied by me?

Information collected from users of premium content: If you choose to subscribe to certain College Prowler Services you may be asked to supply certain personally identifying information such as name, postal address, email address or telephone number. This information is retained by College Prowler in order to provide you with the products or services you have requested, including additional information from College Prowler about College Prowler, its affiliates, or selected outside companies whose products or services we feel may be of use to you. Any information from selected outside companies will be transmitted by College Prowler so that such companies will not have access either to your E-mail address or to your other personally identifying information.

Information collected from College Prowler scholarship applicants: When submitting an application for the scholarship contest, applicants may opt-in to receive student related offers from College Prowler and our trusted business partners. The choice is entirely optional and has no impact on the applicant's submission to the scholarship contest. If a scholarship applicant indicates an interest in receiving offers from College Prowler and its trusted business partners, College Prowler reserves the right to use your personal information and may sell or share it with selected outside companies. If you express interest in particular schools or affiliates, College Prowler may sell or transfer your personal information to those schools or affiliates accordingly.

Information collected from College Prowler account registrants: Information collected in the registration process may include, among other things, name, address, e-mail address, phone number, age, citizenship, details of academic and work history, preferences about the students future and other information entered into the student account. All information entered is voluntary and it is solely up to the student whether he or she furnishes such information. If a student does provide such information, he or she is consenting to the use of that information in accordance with the policies and practices described in this Privacy Policy. If you express interest in particular schools or affiliates, College Prowler may sell or transfer your personal information to those schools or affiliates accordingly. Visitors to the College Prowler Services will not be able to view the personal contact information of any College Prowler Services users. Personal contact information includes a user’s full name, email address, mailing address, and phone number. Only the account user is able to edit and update the information provided in his or her account. We may, on occasion, email our users to send notifications related to features on the site. It is our intention to give access to your account only to the authorized Representatives you designate but we cannot guarantee that others will not, without our consent, access this data. You may opt out of any future usage of your College Prowler account from our database at any time; however, a Representative may have saved a copy of your account before it was deleted. We are not responsible for the retention, use or privacy of accounts in this situation.

Information collected from users of Ovrlap and other College Prowler Apps: When you use and install a College Prowler application on Facebook, you allow College Prowler to access certain information from your Facebook profile to establish your profile within the application. The information you allow the College Prowler application to access is affected by the privacy settings you establish at Facebook. As allowed by you based upon your Facebook settings, the College Prowler application will access and store for caching purposes only the following information from your Facebook profile:

• Your name
• Your current city and hometown
• Your work history and education
• Your current profile picture
• Your email address
• Your connections and their work history, education and profile picture

You can control how much of your Facebook profile information is shared with other College Prowler application users using the Settings function with the application. Regardless of these settings your College Prowler application profile information will be automatically shared with your Facebook friends and their friends within the application. We will prompt you before posting any College Prowler application activity onto Facebook.

Users who wish to deactivate their profiles may do so at any time using the Settings function.

Information collected automatically: When you visit and interact with College Prowler Services certain information may be collected automatically, including but not limited to, your computer's IP address, your browser type, and web pages visited. Please also see our discussion of the use of cookies and other technologies below.

Information sharing: The information that you provide to us and general information collected about your visit to the College Prowler Services may be shared with our suppliers or service providers who assist us in maintaining and managing the College Prowler Services. In addition, we contract with certain third parties to help manage and optimize our web sites. These companies may use web beacons and cookies to help us learn things like what pages are most attractive to our visitors, which of our products most interest our customers, and what kinds of offers our customers like to see. Such suppliers or service providers may use the information provided only in the course of providing services to College Prowler and they may not contact you or use the information for other purposes. While your individual information is protected as discussed above, College Prowler reserves the right to use such individual information to create aggregated, anonymous data and statistics about activity on the College Prowler Services. In addition, College Prowler may disclose personal information if we in good faith believe that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend our rights and property; (3) protect against misuse or unauthorized use of the Web site; or (4) protect the personal safety, property, or rights of our users or the public.

If, at some point after giving College Prowler your personally identifying information, you do not wish to continue to receive additional information from College Prowler about College Prowler, its affiliates, or selected outside companies, in general, you may opt out by E-mailing support@collegeprowler.com and put the words "remove my name" in the subject line of your E-mail; in the case of our E-mail newsletters, you may opt out by clicking on the "opt out" link at the end of each E-mail.

What are "cookies" and "pixel tags" and how do you use them?

Cookies are pieces of information that are placed by a Web site in a storage place on your computer. Cookies do not contain information that is, in itself, personally identifying. Cookies are placed on your computer in a limited way to help deliver advertisements, to calculate unique site visitors, and to track usage throughout our site. Other uses include placement of cookies to make the login process more convenient for users of the College Prowler Services.

We participate in cookie based advertising networks. These networks may use cookies to collect anonymous information about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. Pixel tags - tiny graphic images – are used to help us analyze your online behavior. Pixel tags also allow us to send you email in a format you can read and let us know when you have opened an email message from us. We may use pixel tags to collect information about your visit, including the pages you view, the links you click and other actions taken in connection with our sites and services. We also collect certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring web site addresses.

College Prowler Services uses ClickTale web analytics service. ClickTale may record mouse clicks, mouse movements, scrolling activity as well as text you type. College Prowler Services does not use ClickTale to collect any personally identifiable information. ClickTale does not track your browsing habits across web sites which do not use ClickTale services. For more information see Privacy Policy for Information Collected by the ClickTale Web Analytics Service. We are using the information collected by ClickTale service to help improve the functionality and usability of the College Prowler Services. You can choose to disable the Service at http://www.clicktale.net/ disable.html.

Children's Online Privacy Protection Act

No one under the age of 13 should provide any personal information. In general, College Prowler does not knowingly collect personally identifiable information from children under 13. If in limited circumstances we do knowingly collect personally identifiable information from children under the age of 13, we will do so only with verified parental consent prior to collection. In the event that we learn that we have collected information from a child under the age of 13 without verification of parental consent, we will delete this information from our database as quickly as possible.
